CDE Extends ESSER III Expenditure Plan Deadline

Yesterday, July 14, 2021, the California Department of Education (CDE) updated the deadline for the Elementary and Secondary School Relief (ESSER) III Expenditure Plan from September 30, 2021, to October 29, 2021, after receiving confirmation from the U.S. Department of Education. As part of the federal American Rescue Plan (ARP) Act, which was signed into law on March 11, 2021, local education agencies (LEAs) must complete a Safe Return to In-Person Instruction and Continuity of Services Plan and the ESSER III Expenditure Plan.

AB/SB 130 Education Budget Trailer Bill Released

The trailer bill, among other things, authorizes Universal Transitional Kindergarten, Expanded Learning programs, Special Education Preschool and the Educator Effectiveness Block Grant; expands many existing programs, including the California Community Schools Partnership Program and various educator pipeline programs; amends the Independent Study statute; and makes major changes to the Local Control Funding Formula. Legislature Adopts Revised 2021-22 Budget Package

On June 28, 2021, the California State Assembly and Senate reached nearly a final budget agreement with Gov. Gavin Newsom on how to spend $262.6 billion, of which $196.4 billion is from the state General Fund. The final budget package relies on the governor’s May Revise revenue estimates, in addition to $1.6 billion in higher-than-expected April and May revenues, but does not account for June revenues. The Legislature’s budget report recognizes that there are a few outstanding issues that need resolution, including child care rate increases and reform. The education trailer bill language is expected to be released on Thursday, July 1, 2021. The following are key elements of the overall state budget package, which will be in effect by July 1, 2021.

Governor Newsom Signs Executive Order Expediting Cal/OSHA Revised Emergency Temporary Standards; California Moves Beyond the State Blueprint for a Safer Economy

On June 17, 2021, the California Division of Occupational Safety and Health (Cal/OSHA) Standards Board adopted revised COVID-19 prevention emergency temporary standards (ETS) after withdrawing the previously approved revisions on June 9 to align to the latest California Department of Public Health (CDPH) new face covering guidance. These revised standards are the third set of changes, for which Governor Newsom has waived the 10-day review process by the Office of Administrative Law through an executive order signed this afternoon, and will take effect upon their filing with the California Secretary of State. Employers must comply with the November 30, 2020, ETS until the new standards take effect.

Cal/OSHA Standards Board Approves Revised Emergency Temporary Standards
